Maskell, a 47-year-old man, was initially sentenced to eight years in prison with a non-parole period of five years for his drunken assault on Burke. However, a recent retrial has resulted in a shorter sentence, leaving many feeling outraged and confused.
The assault occurred on August 8, 2021, when an intoxicated Maskell entered a local service station with his partner and daughter. During this unprovoked attack, Maskell's partner called Burke a pedophile, and Maskell proceeded to throw a sports drink bottle at Burke's head, causing him to fall. Maskell then kicked Burke as he lay on the floor, leaving him with a severe brain injury.
Burke, a beloved 73-year-old postmaster, lived alone at the back of his post office and was a familiar face in the community. He was known for his friendly chats with the local service station attendant. Unfortunately, Burke's health rapidly deteriorated after the assault, suffering two strokes and eventually passing away 11 weeks later.
Burke's sister, Suzanne Heppell, described the devastating impact of her brother's slow and agonizing death. She shared how Burke had been optimistic about his recovery initially, believing he would soon return to running the post office. However, his health took a turn for the worse, leaving him paralyzed and unable to communicate or recognize anyone.
Heppell poignantly stated, "One minute John was alive, and the next, he was lying paralyzed, trapped in his own body. I see the community of Strathmerton as a jigsaw puzzle, and John was a significant piece that was taken away."
